Text4swap.com use overview

Text4swap.com is solely for swapping, and exchanging books through offer agreements. Swapping within the Text4Swap.com community involves members listing the books they have to swap within a list called ‘My Books,’ and the books they want to acquire in a list called ‘My Requests.’ You are allowed to list a maximum of seven (7) books in both your ‘My Books’ and ‘My Requests’ lists. An offer request is one in which any Text4swap.com member sends a dollar amount offer to buy a particular book that is listed in another member’s ‘My Books’ list.

Membership Requirements

All registrants of this web site must be 18 years of age or older. Text4swap.com does not discriminate any user based on race, religious preferences, sexual preferences, or gender.

All members are not permitted to:

Give false representation of their identification
List books for any other person
Tamper with any of the content on Text4swap.com
List books they do not have full ownership of, and/or do not have in their possession
Use vulgarity in the form of profanity, verbal threats, or any similar action while setting up or carrying out any transaction on this website
Use Text4swap.com for commercial use
Falsely report that a fellow Text4swap.com member violated theText4swap.com rules and regulations
Use Text4swap.com as an advertising, or network medium to solicit information of any sort. All notifications are subject to review and management of the Text4Swap.com administration. Text4swap.com reserves the right to withdraw and/or order the alteration of any form of notification. Failure to adhere to the demands of the Text4swap.com administration is punishable through suspension, cancellation or any lawful action the administration of this website deems necessary.

Profile Information

Use of false identification is strictly prohibited by Text4swap.com and those found to be in violation of this regulation will be indefinitely restricted from using this website. In addition to being restricted from using Text4swap.com, those found to misrepresent themselves by signing up for membership under a false identity, having committed fraud in doing so, will be prosecuted by Advanced Swapping Innovations, INC to the fullest extent prohibited by law.

Contact Information

All users must always provide valid and complete contact information, and always have a valid e-mail address. Each household is allowed a maximum of two accounts. Users are prohibited from using false addresses to register new accounts. Advanced Swapping Innovations, INC reserves the right to take whatever action it deems fit including, but not limited to, the cancellation of membership for any user who uses an invalid address.

Account Usage Restrictions

Membership for Individual Use Only

Each member is permitted to manage only one account on Text4swap.com. Membership is only for the original registrant, thus temporary or permanent transfer of use of any account is prohibited by Text4swap.com. You agree to never list books for other persons, any organization, any institution, or any association. The listing of books for other persons or any group whatsoever for the exchange of payment, or any right whatever is not permitted on Text4swap.com. Advanced Swapping Innovations, INC reserves the right to take any lawful action it deems fit against those found to be using Text4swap.com membership on behalf of any other person(s) or entity, whether for gain or favor.

Commercial Use Prohibited

Unless otherwise specified, our services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from Text4swap.com’s service. Commercial use is strictly prohibited but not limited to the following:

Listing books on behalf of other persons, institutions, or organizations for payment, or non monetary exchanges of any kind
Acquiring books through our service for resale
Acting as an agent by registering and operating accounts under other individuals’ identity, which is considered fraudulent and is punishable by applicable laws
Acting as an agent by selling or charging registration fees to setup accounts for other users

Using Text4swap.com in any way that we consider to be commercial use is a breach of contract on the part of the offending user(s). Advanced Swapping Innovations, INC reserves the right to immediately cancel membership of anyone found to be using this website for whatever it may consider to be commercial use, without refunding any membership fees. Failure to adhere to the mentioned commercial use stipulation will result in a $50 fine for each unauthorized use of this site. You agree this fine is reasonable and waive your right to dispute it in a court of law, or any other proceeding.

Book Ownership and Condition Rules

Book Ownership

All users who register and become a member of Text4swap.com in doing so are acknowledging and aware they must have full ownership of all the books they list in their ‘My Books’ list, and the said books are to be in their possession and available for trading at all times while the books remain listed. Thus, the books on each user’s ‘My Books’ list at anytime whatsoever indicates the books are available for exchange and will remain so until they are swapped, sold through an offer, or removed from the ‘My Books’ list by the owner of the list prior to a swap request or offer being made for any book.

You hereby acknowledge Text4swap.com has the right to take any action it deems necessary, including the suspension/cancellation of membership, against any and/or all Swappers who list books they either do not fully own, and/or do not have available to swap, or sell in the event an offer is made. Any member who is not able to complete a book-for-book swap, and/or receive a book he/she made an offer and/or payment for due to a Swapper not adhering to any of the mentioned rules, or any other reason that directly indicates a fellow Swapper misled or acted irresponsibly, resulting in a book(s) not being available, thus directly resulting in the incompletion of the trade, may make a report to Text4swap.com and/or give a negative feedback for the offending member.

Book Condition

All members are responsible to give the true representation of the condition of each book he/she lists in their ‘My Books’ list. Advanced Swapping Innovations, INC considers misrepresentation of any book’s condition to be misleading and dishonest. Thus, Advanced Swapping Innovations, INC reserves the right to take whatever lawful action it deems fit against those found to give any book a false description, including, but not limited to, the suspension and cancellation of the account of the user who is in violation. Also, the non offending member has the right to declare the agreement reached between both users void, and may return the book in exchange for the book that he/she sent in the event of a swap transaction, or demand a full refund of the payment made in the event of an offer transaction. The non offending user may also leave a negative feedback for the offending member, and/or make a report of the incident to Text4swap.com.

Swapping and Offer Transaction Rules

All swap and offer requests are subject to acceptance by the Swapper/s to whom swap requests or offers are made. Each Swapper within the Text4swap.com community has the right to deny any swap request, or offer, for any reason he/she sees fit. All Swappers who register and become a member within the Text4swap.com community agrees that when a request to swap, or an offer is initiated, once either party accepts a swap request, or an offer request, they are to fully carry out their responsibilities which include, but are not limited to:

1) In the event of the acceptance of a direct swap request both members are to immediately (no later than 4 days following the acceptance of the request) ship their books via the method they agreed to for the respective transaction.

2) The receiving swapper of a secure swap request is required to accept/deny each request within seven (7) days. Failure to accept/deny any secure swap request by the seventh day following the date the request was made will result in the transaction being automatically cancelled by Text4Swap to avoid further delay of the swap process.

3) To accept a secure swap request the receiving swapper is required to pay the transaction fee specified by Text4Swap. Simply clicking “accept” will not register the request as accepted. Text4Swap will only honor the claim of acceptance of secure swap requests for swappers who completed and received confirmation of their payment.

4) After the receiving swapper accepts the initiating swapper’s request, the initiator is then required to complete his/her transaction fee payment in seven (7) days from the date the receiving swapper paid his/her transaction fee. If the initiator fails to pay in the time specified the transaction will be automatically cancelled by Text4Swap. The initiator also has the option to cancel the transaction before the 7th day deadline, avoiding further delay of the swap process.

5) In the event of a secure swap request transaction, when both parties would have paid their transaction fees and received instruction on sending their books to Text4Swap, each swapper is required to ensure their book arrives at the Text4Swap location specified in the shipment instructions no later than seven (7) days following the date posted on the shipment instructions e-mail. If both books are not received in seven (7) days following the date posted on the shipment instructions e-mail the transaction may be voided in the best interest of both parties to avoid delaying the swap process. Agreeing to these Terms and Conditions, in the event a secure swap transaction is cancelled due to your failure to ensure your book arrives at the specified Text4Swap location within seven (7) days following the date posted on the shipment instructions e-mail, you hereby give Text4Swap the authority to deduct from your transaction fee the shipment cost to:

a) Return the other swapper’s book if it had arrived at the Text4Swap location by the seventh day following the date posted on the shipment instructions e-mail.

AND/OR

b) Return the other swapper’s book if it had arrived at the Text4Swap location by the seventh day following the date posted on the shipment instructions e-mail, and the cost to return your book if it arrives at the Text4Swap location after the seventh day following the date posted on the shipment instructions e-mail.

c) Return your book if the other swapper also failed to send his/her book by the seventh day following the date posted on the shipment instructions e-mail.

6) In the event of the acceptance of an offer request the member who made the offer agrees to, in 4 days, pay the full amount accepted by the owner of the book via the method both members agree on. In turn, the member who accepts the offer agrees to ship the requested book(s) minimum 4 days following the receipt of full payment of the offer.

Other Swapping Transaction Rules

Whenever a swap request is accepted both members are required to send the book they agreed to swap for (i.e. the book of the same name, edition, condition and all the respective descriptions listed for the book at the time of the finalization of the agreement). Members are not allowed to send another book, or a book in a condition that is of great difference to the description that was posted at the time the agreement was reached to perform the respective transaction. Violation of any of the mentioned rules can void the original agreement between the users, and thus the non offending member may make a report to Text4swap.com and/or give a negative feedback for the offending member. Also, the non offending member has the right to return the book he/she received in exchange for the book he/she sent to the offending member. Advanced Swapping Innovations, INC reserves the right to take whatever lawful action it deems fit against such offenders, including, but not limited to, the suspension and cancellation of the account of the user who is in violation.

Other Offer Transaction Rules

In the event the owner of any book accepts an offer, or the member making the offer accepts a negotiated price assigned by the owner of the book, a purchase agreement is reached and the Swapper who made the original offer is expected to pay the agreed charges. Everyone who registers and become a member of Text4swap.com in doing so acknowledges the stated offer transaction requirement, and therefore agrees to act accordingly. Failure to pay the agreed charges is a violation of the offer transaction rules, and thus the non offending member may make a report to Text4swap.com and/or give a negative feedback for the offending member. Advanced Swapping Innovations, INC reserves the right to take whatever lawful action it deems fit against such offenders, including, but not limited to, the suspension and cancellation of the account belonging to the user who is in violation.

Swapper/User Rating

You understand your ratings are public information and left to the discretion of other swappers. You acknowledge this information will be made available to all swappers. You agree you have full responsibility for all transactions carried out on your Text4swap.com account, and note Text4Swap.com does not make any implications or promises to interfere in any discrepancy which may arise due to ratings you are given, and/or ratings you assign for any other swapper.

Payments

Secure Swap Payment

You hereby acknowledge Secure Swap requests will not be processed by Text4Swap until all transaction fee payments are paid by both parties involved in each transaction. You agree to pay whatever amount is specified by Text4Swap to complete secure swap transactions. Text4Swap reserves the right to change the cost of secure swap transactions at any time before secure swap requests are accepted and paid by the receiving swapper. You agree to pay the full cost to send each book to the Text4Swap location for Text4Swap to perform the exchange.

Offer Agreement Payment

PayPal is the only medium of payment Text4swap.com recommends to pay for books being acquired through offer agreements. Text4swap.com recognizes Paypal as a reliable and safe medium for payment transactions, as it relates to how they are carried out and Paypal’s trading protection policies as stated on Paypal.com. However, Text4swap.com is not a representative of Paypal, and any user who chooses to accept and/or make payments through Paypal does so independently, and hereby agrees he/she is bound to the terms and conditions as set forth by Paypal’s Terms of Use.

The following payments are not allowed on Text4swap.com:

• Send cash through the mail

• Send cash or money orders through instant, point-to-point cash transfer services (that are not banks) such as Western Union or MoneyGram

• Mail checks or money orders

• Pay through bank-to-bank transfers

• Pay by "topping off" a seller's prepaid credit or debit card

• Pay using online or other payment methods not specifically permitted in this policy

Text4swap.com’s policy on payment is intended to provide its members safety and convenience. All Text4swap.com statements on Offer Agreement payments are recommendations that we strongly believe will maintain a fair and lawful user environment. Nonetheless, all the statements are recommendations and we do not take responsibility for any Offer Agreement payment transactions whatsoever.

Though Text4swap.com will not take responsibility for any loses or events which may occur due to problems with Offer Agreement payments we will attempt to resolve any issues that arise due to such issues regarding payment by serving as a mediator between the involved parties. Before reporting the issue to Text4swap.com you agree you will first:

1) Contact and keep proof of communication with the party with whom the payment transaction is being carried out

2) Seek the help of any authoritative personnel that may exist for the medium of payment used (e.g. Paypal’s customer service if the payment is made through Paypal)

3) Retract payment if possible in the event there is a suspicion of foul play

If the recommendations above do not resolve the issue, members should at all times report the incident to Text4swap.com. In doing so we may carry out an investigation to ensure none of the users involved are abusing their membership, which threatens the safety and experience of other users. Also, you agree to evaluate all incidents by making sure to eliminate those which may have arisen due to misunderstanding on the part of all the involved parties. In so doing, all users should at the conclusion of the transaction, despite a negative or positive outcome give a membership feedback which is a true representation of each transaction individually.

Advanced Swapping Innovations, INC reserves the right to take whatever action it deems fit against members who fail to pay for any book, including, but not limited to, the suspension and cancellation of the account of the user who is in violation.

Shipping

Direct Swap and Offer Agreement Shipping Policies

DELIVERY ADDRESS

You hereby acknowledge all the books that are to be delivered to you will be sent to the address specified in the Profile Information portion of your Text4Swap.com ‘My Account,’ unless you specify otherwise, and receive confirmation of your request to change your primary address from the member that is sending the book(s) for a particular transaction. You agree to mange and keep an updated, reliable, and safe address where your books can be securely delivered. Advanced Swapping Innovations, INC will not be responsible for any mishaps which may occur to books sent to you due to your failure to change or specify an alternate address when necessary.

PROMPT SHIPMENT OF BOOKS REQUIRED

You hereby acknowledge and agree to ship all the books you list on Text4swap.com at least 4 days following the finalization of every Direct Swap, and Offer Agreement transaction.

FAILURE TO SEND BOOKS

Failure to send books following the finalization of any swap, or offer transaction, on Text4swap.com arrived at while using Text4Swap.com or arrived at as a result of connections made through Text4Swap.com is strictly prohibited. In the event you are unable to promptly ship any book you agree to immediately notify the member that the book is to be sent to within 4 days from the date the respective transaction was finalized. If you do not send any book after 13 days of a transaction being finalized you must return any books sent to you by the other swapper in the case of a Direct Swap transaction, and you must return the other swapper’s payment in the case of an Offer Agreement transaction.

You also agree to report any member’s failure to ship any book you are to receive to Text4swap.com within 13 days following the date the respective transaction was finalized. A negative feedback is also to be left for the profile rating of the offending member.

Text4swap.com is not responsible for any member failing to send any book they are to ship. However, we will attempt to resolve any issues that arise due to such issues regarding shipping by serving as a mediator between the involved parties. Before reporting the issue to Text4swap.com you agree you will first:

1) Contact the member that is to send the book by the fifth day following the swap, or offer transaction finalization and keep proof of communication

2) Contact the customer service of the shipping courier that the offending user agree to send the book(s) with to investigate and confirm any claims of failing to send your items due to the obstruction of the respective shipping courier’s policies

3) Contact the customer service of the shipping courier that the offending user agree to send the book(s) with to investigate and confirm any claims faults of the courier, including but not limited to losing the book, was the reason your book/s were not delivered to you successfully

Advanced Swapping Innovations, INC reserves the right to take whatever lawful action it deems fit against members who fail to ship any book, including, but not limited to, the suspension and cancellation of the account of the user who is in violation.

METHOD OF SHIPPING

Text4swap.com gives all users the option to select a shipping preference. Selection of a particular preference of shipping indicates the individual’s primary choice for books to be sent to him/her. Thus, it is the responsibility of all users to take note of all members’ shipping preference before requesting or finalizing a swap, or offer transaction.

All members hereby acknowledge they are to ship their books via the shipping method selected by the members they are sending their books to, unless otherwise specified by the party the exchange is being carried out with for a particular transaction. Failure to do so is strictly prohibited on Text4swap.com and may result in penalties including receiving negative feedback ratings, and/or suspension/cancellation of the offending member’s account.

SHIPPING CHARGES

You agree to pay all shipping charges for the books you are responsible for sending. Textswap.com is not liable for any occurrences that are related to, or result from shipping of books that are agreed to be transacted through our website. Payment for the books being sent to you are to be paid in full by the member(s) sending the books.

INSURANCE OF BOOKS SHIPPED

Text4swap.com does not guarantee or imply in any way the insurance or protection of any of the books sent under Direct Swap and/or Offer agreements. The books are the property of the members who list them and the transference of ownership is between the members carrying out any Direct Swap and/or Offer agreement transaction. In the event of Direct Swap and/or Offer agreement transactions Text4swap.com simply serves as a medium to reach an agreement that the books will be shipped. Hence, Advanced Swapping Innovations, INC is not responsible for any incidents which may occur as a result of the said agreements reached through our website, including but not limited to, the loss or damage of any book sent.

You agree to investigate and properly review all claims of incidents including, but not limited to, loss or damage of books that you receive or fail to receive due to shipping. Any signs of foul play must be reported to Text4swap.com so as to allow us to further investigate the issue. Advanced Swapping Innovations, INC reserves the right to cancel or suspend the membership of, or take any other steps it deems necessary against, any user who is found to make false reports of loss or damage of book(s) they send, in the case of the sender, and/or receive, in the case of the member who is to receive, and receives the book(s).

Secure Swap Shipping Policies

DELIVERY ADDRESS

You hereby acknowledge all the books that are to be delivered to you will be sent to the address specified in the Profile Information portion of your Text4Swap.com ‘My Account,’ unless you specify otherwise, and receive confirmation of your request to change your primary address from Text4Swap for respective transaction you need your address changed for. You agree to mange and keep an updated, reliable, and safe address where your books can be securely delivered. Advanced Swapping Innovations, INC will not be responsible for any mishaps which may occur to books sent to you due to your failure to change or specify an alternate address when necessary.

UNDELIVERABLE

Each member is responsible for updating his/her address in the Profile Information portion of their Text4Swap.com ‘My Account.’ Books that are returned to Text4Swap.com as undeliverable due to incorrect address information, or because the address was not suited for the receipt of the delivery will not be re-shipped by Text4Swap for free. Second attempts to deliver books will result in the intended recipient being charged the amount of the shipping cost to resend the book. Text4Swap.com does not guarantee the safety of books that have to be held at our location for periods exceeding 20 days, due to issues involving the address information provided by any swapper.

PROMPT SHIPMENT OF BOOKS REQUIRED

You hereby acknowledge and agree to ship all the books involved in finalized (those in which both swappers complete transaction fee payment) in a time period which will guarantee each book arrives at the Text4Swap.com location no later than seven (7) days following the date posted on the shipment instructions e-mail. If both books are not received in seven (7) days following the date posted on the shipment instructions e-mail the transaction may be cancelled in the best interest of both parties to avoid delaying the swap process. Agreeing to these Terms and Conditions, in the event a secure swap transaction is cancelled due to your failure to ensure your book arrives at the specified Text4Swap location within seven (7) days following the date posted on the shipment instructions e-mail, you hereby give Text4Swap the authority to deduct from your transaction fee the shipment cost to:

a) Return the other swapper’s book if it had arrived at the Text4Swap location by the seventh day following the date posted on the shipment instructions e-mail.

AND/OR

c) Return your book if the other swapper also failed to send his/her book by the seventh day following the date posted on the shipment instructions e-mail.

FAILURE TO SEND BOOKS

Failure to send books following the finalization of any Secure Swap transaction on Text4swap.com is strictly prohibited. Agreeing to these Terms and Conditions, in the event a Secure Swap transaction is cancelled due to your failure to send any book involved in the respective transaction, you hereby give Text4Swap the authority to deduct from your transaction fee the shipment cost to return the other swapper’s book if it had arrived at the Text4Swap location. Advanced Swapping Innovations, INC reserves the right to take whatever lawful action it deems fit against members who fail to ship any book, including, but not limited to, the suspension and cancellation of the account of the user who is in violation.

METHOD OF SHIPPING

You agree to use the method of shipping, and adhere to the instructions for shipping specified in the Text4Swap shipment instructions e-mail sent to you following finalization (after both users involved in a Secure Swap transaction pays the transaction fee) of each Secure Swap agreement.

SHIPPING CHARGES

You agree to pay all shipping charges to send your book to the Text4Swap.com location specified in the shipment instructions e-mail sent to you for each Secure Swap transaction. You also agree to pay the shipment charges for Text4Swap to re-send books that are returned to Text4Swap as undeliverable, or returned due to the address specified in your profile being unsuitable for delivery of any book you are to receive.

Insurance of Books Shipped

Text4swap.com does not guarantee or imply in any way the insurance or protection of any of the books sent as a result of Secure Swap agreements. Prior to reaching the Text4Swap.com secure site for exchange, textbooks are the sole property of the sender, and thus you agree to take up all claims to all occurrences which result during the delivery from you to Text4Swap.com with the courier with whom you have contracted to deliver the book. Upon receipt of books for exchange, Text4Swap.com agrees to keep books only in the manner in which the books were received. Text4Swap relieves itself of all responsibility for damages or any other occurrences which take place prior to books being delivered to any of our locations. Also, Text4Swap.com does not take responsibility for occurrences which result in the damaging, or loss, or any occurrence which result in the condition of the book being changed from that which it was deliver to our location in, if any and all these and other occurrences result from any act of God. These acts of God include, but are not limited to any and all natural disasters. Text4Swap.com also relieves itself of any incidents which occur due to acts of man which are not related to the regular operations of Text4Swap.com. These acts of man may include, but are not limited to arson, theft etc.

You agree to investigate and properly review all claims of incidents including, but not limited to, loss or damage of books that you receive or fail to receive due to shipping. Any signs of foul play must be reported to Text4swap.com so as to allow us to further investigate the issue. Advanced Swapping Innovations, INC reserves the right to cancel or suspend the membership of, or take any other steps it deems necessary against any user who is found to make false reports of loss or damage of book(s) they send, in the case of the sender, and/or receive, in the case of the member who is to receive and receives the book(s).

Service Fee

Joining the Text4swap.com community is free for the first year. After the first year Swappers are required to pay a $10.00 service fee. After the first year membership will last for one (1) year from the date of renewal. The date of renewal is considered to be the date a valid credit card payment of $10 is processed by Text4swap.com.

The credit card listed under each Swapper’s ‘Billing Information’ is the card that will be charged on the renewal date. Hence, if the credit card listed for any Swapper is expired, or doesn’t have sufficient funds, or any other issues which may result in the incompletion of the processing of the service fee payment, the renewal of the account will be delayed to whichever date you manually renew your membership.

You agree to update the method of payment used to pay the Text4swap.com service fee. We take no responsibility for any fault whatsoever which may result in the renewal of your account failing.

Advanced Swapping Innovations, INC reserves the right to change the original $10.00 service fee at any time. We do not in any way guarantee the original $10.00 service fee will be the service charge indefinitely following membership registration.

Cancellation

Advanced Swapping Innovations, INC reserves the right to cancel any member’s account without notice at any time it considers to be fit for doing so. You agree as a Text4swap.com member you are not entitled to any compensation following the cancellation of your membership for any reason.

Refunds

The first year of Text4swap.com membership is the trial period which is free. By renewing your membership you are indicating you made use of the trial period and are aware, and accepting of the service and functionalities of Text4swap.com.
